RULES AND GUIDELINES
Once again we find we have to remind subscribers of the Rules and Guidelines of
subscribing to Worldscale. In particular we have found that it is fairly widespread
practice for subscribers to pass on Worldscale information and rates to other parties
who do not subscribe to Worldscale. This is a direct contravention of paragraph 3) , and
also subject to the warning given in paragraph 7) , of the Rules and Guidelines which
all subscribers have signed a written declaration to abide by. We reiterate that ‘the
Worldscale Associations will take such action as it considers necessary, including
immediate termination of a subscription and with it access to Worldscale, in the event
of the Association discovering clear evidence of an infringement of copyright or the
terms of the subscription agreement ‘ . The Rules and Guidelines, Terms and Conditions
of subscription and Privacy Policy can all be found on the home page of the website.
We would like to inform all subscribers once again that the Worldscale Association is a
strictly non profit making organisation with it’s only income from subscriptions. Any
excess funds are ploughed back into the organisation in an effort to keep abreast of the
latest technology in order to be able to provide a better service. With the recent
mergers of oil majors and other companies subscription numbers and Worldscale revenue
has fallen. This has been exacerbated by the minority of subscribers we have found to be
passing on rates and information to those users who avoid paying for a subscription.
Subsequently ‘excess funds’ is a rare occurrence these days. If all those who use
Worldscale were to use it legitimately then there would be sufficient funds to move
forward every year and maybe even lower subscription levels.
Worldscale is non profit making and is ‘sponsored ‘ by the industry to provide a
necessary service and ‘chartering tool ‘ for all concerned in the shipping of oil in
bulk. A subscription works out at around ten US dollars per day. The inherent spirit
since Worldscale’s inception has been one of mutual and interactive cooperation between
the Associations and it’s faithful subscribers. We hope to be able to keep it that way.

BECAUSE OF THE NUMBER OF SOURCES FROM WHICH THE WORLDSCALE ASSOCIATIONS OBTAIN
CONTENT AND THE NATURE OF ELECTRONIC DISTRIBUTION VIA THE INTERNET (OR OTHER
ELECTRONIC DEVICES), THE WORLDSCALE ASSOCIATIONS DO NOT GIVE ANY WARRANTIES IN
RESPECT OF THE SITE CONTENT TO THE EXTENT ALLOWED BY APPLICABLE LAW, THE
WORLDSCALE ASSOCIATIONS HEREBY DISCLAIM ALL WARRANTIES, CONDITIONS OR DUTIES OF
EVERY NATURE WHATSOEVER (EXCEPT ANY DUTIES OF GOOD FAITH), INCLUDING WITHOUT
LIMIATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A
PARTICULAR PURPOSE, ANY EXPRESS OR STATUTORY WARRANTIES, ANY WARRANTIES OR
DUTIES REGARDING ACCURACY, TIMELINESS, COMPLETENESS, PERFORMANCE, LACK OF
NEGLIGENCE OR OF WORKMANLIKE EFFORT.

TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT THE WORLDSCALE
ASSOCIATIONS WILL NOT BE LIABLE TO YOU AND/OR ANY THIRD PARTY FOR ANY
CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO, LOST
PROFITS, LOSS OF PRIVACY OR FOR FAILURE TO MEET ANY DUTIES INCLUDING, BUT NOT
LIMITED TO, ANY DUTY OF GOOD FAITH, LACK OF NEGLIGENCE OR OF WORKMANLIKE
EFFORT) OR FOR ANY OTHER INDIRECT SPECIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISE
OUT OF OR ARE RELATED TO THE SITE OR TO ANY BREACH OF THESE TERMS BY THE
WORLDSCALE ASSOCIATIONS, EVEN IF THE WORLDSCALE ASSOCIATIONS HAVE BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IN THE EVENT OF FAULT, TORT
(INCLUDING NEGLIGENCE) OR STRICT LIABILITY.

The first edition of the New Worldwide Tanker Nominal Freight Scale came into
effect on 1st January 1989. This document is a revised edition and does not
constitute a new or separate freight scale.
The Associations accept no responsibility for any loss (including consequential
loss), expenses or damages arising out of any inaccuracy, breach of contract,
the commission of any tort or any other infringement of any rule of law, duty
or obligation recognised in any system of law, relating to the preparation of
distribution of this document (and any amendment or supplement thereto) or to
the contents thereof. No warranties are made, express or implied, with regard
to the contents of this document, its merchantability, or fitness for a
particular purpose.

Rules
And Guidelines In Respect Of Subscribing To "WORLDSCALE"

A
subscription to Worldscale runs from January to December of any one year and is
renewable each year. Each October, renewal invoices are despatched to
subscribers. All subscribers making payment before 1st December will receive
their schedules before 1st January of the following year. A subscription to the
web site cannot be obtained until a subscription to the
Schedule has been taken out.

A
subscription payment and completed application form must be received before
a Schedule is despatched and before a web site licence is activated.

3)
|
Subscribers
sign an undertaking on the application form relating to the use of Worldscale.
Only the name and address shown on the application form are the registered
subscribers and no Worldscale Schedules or information may be passed to any
other companies whether they be Associate, Parent or Sister companies or branch
offices. All offices wishing to use Worldscale will have to subscribe in their
own right.

A
subscription entitles the subscriber to one free Worldscale Schedule plus all
updates issued throughout the year. They are also entitled to telephone, telex,
fax or email the Associations for any rates not included in
the Schedule.

5)

Subscribers
are also entitled to purchase additional Schedules at a reduced fee
for use only within their own offices and not to be passed on to any other
persons. Similarly extra licences for the website may be purchased at a set
fee.

All
content and information, including the freight rates, contained on the website
are the copyright of Worldscale. Users may download printed copies of the
material displayed on this website for personal use only, provided that each
user retains the copyright notice identifying Worldscale as the owner. Users
may not print, copy, reproduce, download, republish, broadcast, transmit,
display, modify or re-use the material from this website for any other purpose,
including in particular any purpose which re-sells or publicly re-uses the
materials.

Subscribers should be aware that the
Worldscale Associations will take such action as considered necessary,

The contents of this website and
users' access to it are governed by English law and all users submit to the
exclusive jurisdiction of the English Courts in relation to any dispute arising
out of it.

While
at all times we do endeavour to be as helpful as possible to our subscribers we
do urge them to realise that it would be impossible to produce the Schedule and
give a service at the current fee, if subscribers order additional Schedules to
pass to other offices. This would also be an infringement of the copyright law
in respect of Worldscale.
